These Terms of Service govern your use of the website operated by MGY Construction Inc ("the House," "we," "us"), 6543 Fulcher Ave, North Hollywood, CA 91606, United States, and the general conditions of wholesale sales by the House. By accessing this website, you agree to these terms.

1. Nature of This Website

This website is provided for general informational purposes — describing our divisions, stocked lines, and ordering process. It does not constitute a real-time inventory, a price list, or an offer to sell. No sale is formed by visiting this site or submitting an RFQ; a sale is formed only by an accepted purchase order or signed sales confirmation.

2. Wholesale Sales Only

The House sells merchandise exclusively to trade buyers — contractors, retailers, and institutions — in wholesale lot quantities. We do not sell to consumers for personal use. Trade accounts are opened by application and are subject to credit review. Terms and pricing are quoted per order or per account and are valid for the period stated on the quote.

2.1 Ordering

Orders are accepted in case, carton, or pallet quantities as specified per product line. Order acceptance is subject to stock availability, credit standing, and the buyer's acceptance of quoted pricing, lead times, and terms.

2.2 Title and Risk

Title and risk of loss pass to the buyer upon delivery to the carrier at our dock, unless otherwise agreed in writing. Delivery dates are estimates; the House is not liable for delays beyond its reasonable control.

3. Product Information and Warranties

Products are sold with the manufacturer's warranty, if any; the House extends no warranty beyond that of the manufacturer. Product descriptions and specifications on this website are provided by manufacturers and are not guaranteed to be complete or current. Buyers are responsible for verifying that products meet applicable codes, specifications, and licensing requirements for their intended use.

3.1 Returns

Returns require prior authorization and are subject to the return conditions stated on the sales confirmation — including restocking charges, freight responsibility, and documentation requirements. Special-order and cut-length goods are not returnable.

4. Intellectual Property

All content on this website — including text, graphics, layout, and design — is the property of MGY Construction Inc or its licensors and is protected by copyright. You may view and print pages for business use related to trade with the House. No other reproduction or distribution is permitted without written consent.

5. Acceptable Use of This Website

To the maximum extent permitted by law, the House's aggregate liability arising from or related to this website shall not exceed one hundred dollars. Liability for goods is limited to the purchase price of the affected item under the applicable order. In no event shall the House be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or project delays.

You agree to indemnify and hold harmless MGY Construction Inc from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of this website, your misapplication of purchased goods, or your failure to comply with applicable codes and regulations.
